1. Terms of Use Agreement

This Terms and Conditions of Use Agreement ("Terms of Use") constitutes a binding agreement between you and Insurance Quote America. Please carefully read through all sections of these Terms of Use. By accessing this web site or any of the web sites owned or controlled by Insurance Quote America (each a "Site" and collectively the "Sites") you agree to be bound by these Terms of Use. Additionally, please be advised that any content you submit to Insurance Quote America, through the customer satisfaction survey (with a testimonial waiver form), through the newsletter, on our Sites, via emails, or otherwise, becomes the property of Insurance Quote America. If you do not acknowledge and agree to these Terms of Use, then do not enter your information and do not continue using our Sites. Your access to and use of the Sites is subject to these Terms of Use and all applicable laws. These Terms of Use may be changed by us from time to time without notice to you, and the latest version will be posted on this Site.

2. Privacy and Security

Your privacy is very important to us. We understand that you entrust us with your private information to help us match you with an insurance agent who can meet your needs. In exchange for your trust, you expect and deserve our commitment to treat your information with respect. Rest assured that we protect your privacy. All personal data provided to us as a result of your use of the Sites will be handled in accordance with our Privacy Policy and that of our affiliate.

By agreeing to these Terms of Use, you agree to the terms of our Privacy Policy. In order to protect your data in transmissions between you, Insurance Quote America, our agent network, and our third party agent networks, we do not collect any personal information from you besides your ZIP code. Our affiliate sites only collect data through secured pages and transactions. These security measures help prevent unauthorized access and maintain data security. No transmission of data over the Internet, however, is guaranteed to be completely secure; information can be unlawfully intercepted by other parties. And we do not monitor our affiliate's systems, and are not responsible for their operation. Though we partner with a trusted and respected industry leader for competitive quoting, we make no guarantees about the operation of our affiliate's systems, their data security, or any other properties of these systems. Once you request a quote with our service, you leave our Sites, and all subsequent transactions of data are governed under our affiliate's Terms of Use and Privacy Policy. Although Insurance Quote America and its affiliates take your privacy very seriously, we cannot guarantee the safety of your information.

3. How our Service Works

Insurance Quote America is an online portal connecting consumers with insurance agents to compete for their business across a variety of insurance policy types. Insurance Quote America is not an insurance agency and does not provide quotes directly to consumers. Rather, Insurance Quote America is a free matching service that instantly connects you with our nationwide network of quality insurance agents.

After you submit your quote request via InsuranceQuoteAmerica.com or via our localized Sites, Insurance Quote America matches you to local and national agents who can meet your insurance needs through the use of an affiliate marketplace. We send your insurance type request and ZIP code to our affiliate, who creates this marketplace connection by emailing you the list of matching agents and their contact information as well as passing your information to the agents. Your matching agents will use the information you provided in your quote request to provide you with a quote. Sometimes, our affiliate does not have a matching agent based on your location and insurance needs. In this event, your information may be passed to one of our affiliate's third party agent networks to ensure that you receive as many competitive quotes as possible.

Insurance Quote America does not charge a fee to use our service. Insurance Quote America is paid a fee by our affiliate, who is paid a fee by the insurance agents who purchase leads through their service.

Insurance Quote America is not an agent of you or the insurance agents; we do not recommend any particular insurance agent or type of insurance. Use your own judgment in choosing an insurance agent and policy. We cannot guarantee that you will receive quotes.

By submitting a quote request, you authorize Insurance Quote America to provide your information to our affiliate, who will collect additional information and provide it to insurance agents, both local and national, in accordance with our affiliate's privacy policy. You authorize these agent networks to share your information with their vendors, suppliers, and insurance carriers in order to generate information for your quotes. By submitting a quote request with our affiliate, you acknowledge that our affiliate's service requires you to agree that our affiliate will obtain a consumer report or credit score from a consumer reporting agency (also known as a credit bureau) and that our affiliate does not have the right to obtain a consumer report or credit score without your written instruction which you are granting by clicking the submit button. Accordingly, by submitting a quote request you instruct consumer reporting agencies to provide a consumer report or credit score on you to our affiliate within a reasonable time from the time you submit information to our affiliate. Our affiliate will obtain this credit information for its sole use and will not share this information with any other party, including insurance carriers, but insurance carriers may elect to obtain credit information on their own in connection with the quoting and underwriting of the requested insurance. Where permitted by law, some insurance companies or their agents may confirm your information, through the use of consumer reports, which may include credit score and driving record.

You understand you are extending an express invitation for insurance agents to contact you by any means provided on your quote request, including your phone numbers and email addresses. If you choose to purchase a policy from a particular agent, any further communications with that agent are not covered under these Terms of Use.

Be aware that submitting a request via our service refers your data to our affiliate for processing. This affiliate is a reputable agency which uses secure data transmissions. However, we do not monitor our affiliate's systems and are not responsible for any loss of security, data breaches, data losses, or other technical or privacy issues on our affiliate's sites and systems. Though we partner with a trusted and respected industry leader for competitive quoting, we make no guarantees about the operation of our affiliate's systems, their data security, or any other properties of these systems. Once you request a quote with our service, you leave our Sites, and all subsequent transactions of data are governed under our affiliate's Terms of Use and Privacy Policy.

4. Minors

Insurance Quote America does not intentionally target anyone under the age of 16. Our Sites and services are not directed toward people under the age of 16, nor do we knowingly collect information from individuals under the age of 16. Individuals between the ages of 16 and 18 are granted permission to use our Sites only with the permission of their parent or guardian.

5. Links to Third Party Web Sites

Insurance Quote America's Sites may contain links to third party sites. These links are provided for your convenience, however InsuranceQuoteAmerica's hosting of these links is not an endorsement of any particular company. Be aware that Insurance Quote America is not responsible for the privacy practices of other sites; we encourage you to thoroughly read the privacy policies of third party sites linked from our Sites to ensure that you are comfortable with their practices.

6. Forum Usage

Some of our Sites allow users to post, submit, or display information, messages, suggestions, questions, comments, postings, advertisements, ratings, ideas, techniques, notes, know-how, audio visual material, photographs and pictures (including pictures of the user and other representations of the user's name and likeness), digital images, or other content in any form (collectively "User Content"). By posting User Content on this Site or any Insurance Quote America Site or Sites, you hereby grant Insurance Quote America an unrestricted, transferable and sub-licensable, irrevocable, royalty-free, world-wide, and perpetual license to reproduce, distribute, publicly display, make derivative works of, and otherwise use the User Content in any media whatsoever now known or later invented throughout the world for any purpose whatsoever, commercial or not. You hereby disclaim any right to any compensation from Insurance Quote America in connection with Insurance Quote America's exercise of its license rights in and to the User Content you have posted on this Site or any other Insurance Quote America Site. You acknowledge and agree that Insurance Quote America is under no obligation of confidence to you, and shall not be liable for any use or disclosure of any User Content. By posting the User Content on any site, you represent and warrant that you own the copyright in such User Content or that you have a legitimate license to post the User Content, including photographs or other audiovisual material, without any restrictions whatsoever.

Insurance Quote America has no obligation to monitor this Site or any portion thereof. However, Insurance Quote America reserves the right to review any User Content and remove, delete, redact, or otherwise modify such User Content, in its sole discretion, at any time and from time to time, without notice or further obligation to you. Permission is hereby granted to lawfully access and use the Sites to display, download, archive and print, portions of the Sites on a temporary basis for your individual use. You may not use any "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process to access, acquire, copy or monitor any portion of the Sites or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Sites or any Content, to obtain or attempt to obtain any materials or information through any means not purposefully made available through the Sites. You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Sites or any transaction being conducted on the Sites, or with any other person's use of the Sites.

You agree to indemnify, release and hold harmless Insurance Quote America and our officers, directors, agents, representatives and employees from any claim, liability, loss, expense or demand, including legal fees, related to your violation of these Terms of Use or your access or use of the Sites.

11. Right to Modify or Discontinue Sites

Insurance Quote America reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Sites (or any part thereof) with or without notice. You agree that Insurance Quote America will not be liable to you or to any third party for any modification, suspension or discontinuance of the Sites.

12. Other Agreements

These Terms of Use may be supplemented or amended by the terms of other "click-through" agreements between you and Insurance Quote America found on our Sites (the "Other Agreements"), or such agreements on our affiliate's sites. In such cases, you may be asked to expressly consent to the terms of such Other Agreements, for example, by checking a box or clicking a button marked "I agree." If the terms relating to the subject matter of these Terms of Use are different than the terms of those Other Agreements, the of the Other Agreements will supplement or amend these Terms of Use.

13. Miscellaneous

This Agreement will be governed and construed in accordance with the laws of the State of Massachusetts and the United States without regard to any conflict of laws principles that would require the application of the laws of another jurisdiction. Any dispute arising under or in connection with this Agreement will be heard exclusively in the state and federal courts for the City and County of Boston, Massachusetts; you hereby expressly and irrevocably consent and waive any objection to the personal jurisdiction, venue and convenience of such courts. No waiver by Insurance Quote America of any breach of or right under this Agreement will be a waiver of any preceding or succeeding breach or any other right.
